Terms of service

Welcome to Rancher's Market. These Terms of Service (the "Terms") govern your access to and use of ranchersmarket.co (the "Site") and any purchase you make from Rancher's Market ("Rancher's Market," "we," "us," or "our"). By visiting the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

1. Who we are

Rancher's Market is a family-run online market based in Miami, Florida. We are not a farm. We source products from independent Florida producers and other suppliers, and we deliver them to customers in our service area. Producer names, farming practices, and product attributes shown on the Site are provided in good faith based on information from our suppliers.

2. Eligibility and accounts

You must be at least 18 years old to place an order. When you create an account or place an order, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for all activity under your account and for keeping your login details confidential. We may refuse service, cancel orders, or close accounts at our discretion, including where we suspect fraud, abuse, or a violation of these Terms.

3. Products, descriptions, and weights

We work hard to describe our products accurately, but we do not warrant that descriptions, images, pricing, or other content on the Site are error-free. Many of our products are natural, hand-cut, or variable-weight items. Stated weights, package counts, and cut lists are approximate and may vary. Where a product is priced by weight, the price charged is based on the approximate weight listed at the time of purchase. Availability changes daily; if an item you ordered is unavailable, we may substitute a comparable item, adjust your order, or refund the affected item at our discretion, and we will make reasonable efforts to tell you.

4. Orders, pricing, and payment

All prices are in U.S. dollars and may change without notice. Applicable taxes and delivery fees are shown at checkout. Your order is an offer to purchase; we accept it when we confirm it, and we may cancel any order before delivery for any reason, including pricing or listing errors, suspected fraud, or unavailability, in which case you will be refunded any amount charged for the cancelled items. Payment is due in full at checkout through the payment methods offered on the Site.

5. Pre-orders and bulk beef shares

Some products, including quarter, half, and whole beef shares and items marked "pre-order," are prepared to order and are not in stock at the time of purchase. For these products:

• Payment at checkout reserves your order with the producer. Lead times shown on the product page (for example, two to four weeks for beef shares) are estimates, not guarantees, and may be affected by processor schedules, weather, or supply.
• Beef shares are sold as a fixed assortment of cuts. The cut list and package weights on the product page are approximate and may vary from animal to animal. We do not offer custom cut sheets on shares.
• We will contact you to schedule delivery once your order is ready. You are responsible for having adequate freezer space available at delivery.
• You may cancel a pre-order for a full refund at any time before it is cut or otherwise prepared for you. Once processing has begun, cancellations and refunds are at our discretion because the product has been custom-prepared.

6. Delivery

We deliver only within the service area shown at checkout. Delivery fees, minimums, and eligible ZIP codes are determined by delivery zone and shown before you complete your purchase. Same-day delivery applies only to in-stock items ordered before the cut-off time shown on the Site, and delivery windows are estimates. Because our products are perishable:

• You are responsible for providing an accurate delivery address and instructions and for making sure someone can receive the order or that a safe, shaded location is available. We may leave orders unattended at the address you provide, and risk of loss passes to you when the order is delivered to that address.
• You are responsible for refrigerating or freezing perishable items promptly after delivery. We are not responsible for spoilage caused by delayed retrieval, incorrect addresses, inaccessible locations, or conditions outside our control.
• If a delivery cannot be completed because of an address error, an inaccessible location, or no one available to receive it where required, we may charge a redelivery fee or treat the order as delivered.
• Deliveries may be delayed or rescheduled due to weather, road conditions, supplier delays, or other events beyond our reasonable control.

7. Raw dairy: important notice

All raw (unpasteurized) milk and raw milk products sold on this Site are sold and labeled as animal food, "not for human consumption," in accordance with Florida law, including Florida Statutes section 502.091. Florida does not permit the sale of raw milk for human consumption. By purchasing raw dairy from us, you acknowledge and agree that:

• You are purchasing the product for animal consumption or other non-human use, and you will use it in accordance with Florida and federal law.
• We make no representation or warranty that any raw dairy product is safe or suitable for human consumption. Raw milk has not been pasteurized and may contain harmful bacteria.
• Any decision to use raw dairy other than as labeled is made solely by you, at your own risk, and without any reliance on statements by Rancher's Market or its suppliers. To the fullest extent permitted by law, you assume all risk arising from such use and release Rancher's Market, its owners, employees, and suppliers from any claim, loss, illness, or damage arising from it.

Nothing on the Site, including product descriptions, blog posts, or customer reviews, is medical, nutritional, or veterinary advice.

8. Food safety, allergens, and health claims

Our products are perishable foods that require proper handling, storage, and cooking. Follow safe food handling practices, including USDA guidance on storing and cooking meat, poultry, seafood, and eggs. Products may be processed in facilities that also handle common allergens. Descriptions such as "grass-fed," "pasture-raised," "soy-free," or "organic" reflect information provided by our producers and are not a guarantee of any health outcome. Consult a qualified professional for dietary or medical questions.

9. Returns and refunds

Returns and refunds are handled on a case-by-case basis and are made solely at Rancher's Market's discretion, as set out in our Refund Policy. Because our products are perishable, please contact us within 24 hours of delivery at johanna@ranchersmarket.co with your order number and photos if an item arrives damaged, spoiled, missing, or materially different from its description, so we can review it.

10. Subscriptions

If you subscribe to recurring delivery of any product, you authorize us to charge your payment method on the schedule you selected until you cancel. You can skip a delivery or cancel at any time from your account before the next order is processed. Prices for subscription items may change, and we will notify you before a price change takes effect.

11. Promotions and discount codes

Discount codes, referral rewards, and promotions are subject to the terms stated when they are offered, may be limited to specific customers, products, or time periods, cannot be combined unless stated, and have no cash value. We may modify or end a promotion at any time and may cancel orders that misuse a code.

12. Communications

By providing your email address or phone number, you agree that we may contact you about your orders and deliveries. Marketing emails and text messages are sent only with your consent, and you can opt out at any time by following the instructions in the message or contacting us. Message and data rates may apply to text messages.

13. Reviews and other content you submit

If you submit reviews, photos, or other content to the Site, you grant Rancher's Market a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business. You are responsible for content you submit and agree not to submit anything unlawful, misleading, or infringing. We may remove content at our discretion.

14. Intellectual property

The Site and its content, including the Rancher's Market name, logo, text, images, and design, are owned by or licensed to Rancher's Market and protected by applicable law. You may not copy, reproduce, or use them without our written permission, except as needed to browse the Site and place orders.

15. Third-party services

The Site may link to or use third-party services, including payment processors, delivery tools, and social platforms. We are not responsible for the content or practices of third parties, and your use of their services is governed by their terms.

16. Disclaimer of warranties

To the fullest extent permitted by law, the Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in these Terms. We do not warrant that the Site will be uninterrupted or error-free.

17. Limitation of liability

To the fullest extent permitted by law, Rancher's Market and its owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to the Site, these Terms, or any product, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Indemnification

You agree to indemnify and hold harmless Rancher's Market and its owners, employees, contractors, and suppliers from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Site or any product, or your use of raw dairy products other than as labeled.

19. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. If you have a concern, please contact us first so we can try to resolve it informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts. Claims must be brought within one year after they arise, to the extent permitted by law.

20. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they were last revised. Changes take effect when posted, and your continued use of the Site after that constitutes acceptance. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the policies referenced above, are the entire agreement between you and Rancher's Market regarding the Site.
